The domain name newempireplastics.com (hereinafter referred to as "Website") is owned and operated by New Empire Plastics, a company incorporated under the laws of India with its registered office at A-25 Navjeevan Industrial Estate, opp Dhuri Resort Navjeevan Naka Vasai East Dist Palghar, Thane, Maharashtra, India, 401208.

Unless otherwise indicated or anything contained to the contrary or any proprietary material owned by a third party and so expressly mentioned, New Empire Plastics owns all Intellectual Property Rights to and into the Website, including, without limitation, any and all rights, title and interest in and to copyright, related rights, patents, utility models, trademarks, trade names, service marks, designs, know-how, trade secrets and inventions (whether patentable or not), goodwill, source code, meta tags, databases, text, content, graphics, icons, and hyperlinks.

You acknowledge and agree that you shall not use, reproduce or distribute any content from the Website belonging to New Empire Plastics without obtaining authorization from New Empire Plastics.

3. User Obligations & Conduct

By way of example, and not as a limitation, you agree and undertake that when using the Website, you will not:

• Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights of others;
• Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information;
• Upload files that contain software or other material protected by intellectual property laws unless you own or control the rights thereto or have received all necessary consents;
• Upload or distribute files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of the Website or another's computer;

• Violate any code of conduct or other guidelines, which may be applicable for or to any particular Service;

4. Products, Pricing & Payment

We strive to provide accurate product and pricing information, however, pricing or typographical errors may occur. New Empire Plastics cannot confirm the price of a product until after you order. In the event that a product is listed at an incorrect price or with incorrect information due to an error in pricing or product information, New Empire Plastics shall have the right, at our sole discretion, to refuse or cancel any orders placed for that product.

Prices and availability are subject to change without notice. All payments made against the purchases/services on the Website by you shall be compulsorily in Indian Rupees acceptable in the Republic of India. We utilize secure payment gateways (like Razorpay) for all transactions and do not directly store your credit/debit card information.

5. Digital Wallet Policy

In compliance with the Reserve Bank of India (RBI) guidelines on Prepaid Payment Instruments (PPIs) and the Information Technology Act, 2000, New Empire Plastics provides a closed-loop digital wallet feature ("Wallet") on our platform, subject to the following terms:

• Usage: The Wallet is strictly a "Closed System PPI" as defined by the RBI. Balances loaded into the Wallet can only be used for purchasing goods directly from New Empire Plastics on this platform.
• No Cash Withdrawal: The Wallet balance is non-transferable to other users or external bank accounts, and cannot be redeemed or withdrawn for cash under any circumstances, in strict accordance with RBI regulations for closed-loop wallets.
• KYC Compliance: Users must maintain accurate account information. We reserve the right to request Know Your Customer (KYC) documentation for high-value wallet top-ups to prevent money laundering and fraud.
• Refunds to Wallet: If you cancel an order paid via the Wallet, the refunded amount will be credited back to your Wallet. Refunds for failed top-up transactions will be credited back to the original source of payment (credit card, bank account, etc.) within 5-7 business days.
• Validity & Expiration: Wallet balances do not expire, ensuring your funds are always available for future purchases with New Empire Plastics.

6. Disclaimer of Warranties

The Website, all the materials and products (including but not limited to software) and services, included on or otherwise made available to you through this site are provided on "as is" and "as available" basis without any representation or warranties, express or implied except otherwise specified in writing.

Without prejudice to the forgoing paragraph, New Empire Plastics does not warrant that: this Website will be constantly available, or available at all; or the information on this Website is complete, true, accurate or non-misleading.

7. Limitation of Liability

In no event shall New Empire Plastics be liable for any special, incidental, indirect or consequential damages of any kind in connection with these terms of use, even if user has been informed in advance of the possibility of such damages. We shall not be held responsible for non-availability of the Website during periodic maintenance operations or any unplanned suspension of access to the website that may occur due to technical reasons or for any reason beyond our control.

8. Indemnification

You agree to indemnify, defend and hold harmless New Empire Plastics, its owners, licensees, affiliates, subsidiaries, group companies (as applicable) and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys' fees, made by any third party or penalty imposed due to or arising out of your breach of this Terms of Use, Privacy Policy and other Policies, or your violation of any law, rules or regulations or the rights of a third party.

9. Governing Law & Jurisdiction

These terms shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles. Any disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts at Mumbai, Maharashtra, India.
